Med-ArbSolutions Ltd. is a wholly Canadian-owned alternative dispute resolution practice incorporated in 2012 with offices across Ontario. Med-ArbSolutions has provided neutral 3rd party proficiency for 1000’s of mediations, investigations, assessments, and restorations across a wide range of organizations.

What We Do

Our team of ADR practitioners are trained in multiple disciplines including trauma informed practice investigators who routinely manage sensitive assignments including workplace investigations involving discrimination, harassment, sexual misconduct, bullying, and toxicity. Clients also rely upon Med-ArbSolutions practitioners to facilitate mediations, conduct neutral 3rd party investigations, perform workplace assessments, and provide recommendations for reducing and preventing conflict in the workplace.

Credentials
Members are in good standing with the Alternative Dispute Resolution Institute of Ontario (ADRIO), the HRPA, the Association of Workplace Investigators, and/or the Law Society of Ontario.
Clearances
Have security clearances through the Ministry of the Attorney General (Ontario), Private Investigators licenses through the Ministry of the Solicitor General, and federal security clearances.
Training
Trained in FIPPA, PIPEDA, AODA, FOIP, OHSA, Privacy Act of Canada, human rights, diversity, equity, and inclusion.
Human Rights
Experienced in provincial, territorial, or federal levels of human rights complaints and/or tribunals including with First Nations and/or BIPOC communities
Workplace
Extensive experience in cases involving insurance claims, occupational health and safety, WDHP programs, and respectful workplace policies.
Social Justice
Experienced in racial bias or profiling cases from provincial, regional, or municipal police services, and in criminal rehabilitation.

How is information collected handled?

Med-ArbSolutions Ltd. does not sell or collect any information for any third parties. All associates are trained on the Privacy Act of Canada and none retain any information after file completion. All documents, information, or case management files are securely kept by Med-ArbSolutions as long as they are required or have been submitted to the client, and then completely destroyed.

How long does it take to complete an assessment?
Typically, investigations and mediations take about 30 days to complete. However actual time to complete may vary based on size of file, complexity, or number of participants.
How do you conduct assessments and interviews?

At Med-ArbSolutions, workplace assessments and interviews are conducted in a procedurally fair manner to ensure that the rights and dignity of all participants are respected. All parties are afforded the right to:

  • Fair treatment
  • Ask questions
  • Privacy and confidentiality
  • Have support people present

The style of interview or information gathering is about trust, confidence, the ability to listen, and ask questions. It is not browbeating, aggressive, or intimidating. It is about fact-finding and based on evidence, statements, and technique. Med-ArbSolutions’ team of skilled ADR professionals deliver all ADR services through a trauma-informed practice lens to reduce or mitigate trauma to employees and corporate culture.

How do you ensure confidentiality?

All investigative reports will be gender neutral and contain identifiers such as “complainant” or “respondent” and witnesses will be named “interviewee 1” or “witness 2” to make sure that, if reports are circulated, lost, or misplaced, that confidentiality will be maintained.

Do you conduct investigations for ministries or provincially-funded organizations?

All investigations for the Ministry of Public Business Service Delivery (ministries or provincially funded organizations) must follow strict guidelines set out by the Workplace Discrimination and Harassment policies and respectful workplace policies. All investigations must incorporate all applicable laws, statutes and policies, as well as all human rights components. Reports must be approved by the WDHP policy advisor and/or designated human resources consultant. They must also be able to withstand challenges by third parties, human rights standards, and be above reproach for impartiality and neutrality. Most investigations involve a unionized context and must conform to all legislation specifically involving human rights, collective bargaining agreements, and labour codes.
